PRIVACY POLICY

Carnival en Cancun 

This page informs attendees of Carnival en Cancun’s policies regarding the collection, use, and disclosure of attendees’ personal data while using the Carnival en Cancun Website (hereinafter referred to as “the Service.”  By using the Service, you agree to the collection and use of your information in accordance with this Privacy Policy. Unless otherwise defined in this Privacy Policy, terms used in this Privacy Policy have the same meanings as in our Terms and Conditions.

Information Collection and Use 

Carnival en Cancun collects different types of information for various purposes including, but not limited to, providing and improving its services to attendees.

  1. Personal Data

While using the Service, and particularly when completing registration forms, Carnival en Cancun may require certain personally identifiable information that may be used to contact and/or identify attendees (“Personal Data”).  Personally, identifiable information may include, but is not limited to:

  • Email addresses
  • First names and last names
  • Phone numbers
  • Addresses, State, Province, ZIP/Postal code, City
  • Dates of Birth
  • Flight information
  • Dates of arrival
  • Dates of departure
  • Cookies and Usage Data
  1. Usage Data

Carnival en Cancun may also collect information from attendees’ browsers whenever attendees visit or access the Service by or through a mobile device (“Usage Data”).  Usage Data may include information such as attendees’ computer’s Internet Protocol address (IP address), browser type, browser version, visited pages of the Service, times and dates of attendees’ visits, times spent on those pages, unique device identifiers, and other diagnostic data.  Additionally, Usage data may also include information such as the type of mobile device used, attendees’ mobile device unique ID, mobile device IP addresses, mobile device operating systems, mobile Internet browser types, unique mobile device identifiers, and other diagnostic data.

  1. Tracking & Cookies Data

Carnival en Cancun may use cookies and similar tracking technologies to track and retain activity on the Service.  Cookies are files with a small amount of data that may include an anonymous unique identifier. Cookies are sent to attendees’ browsers from a website and stored on attendees’ devices. Tracking technologies also used are beacons, tags, and scripts to collect and track information and to improve and analyze the Service. Attendees may instruct their browsers to refuse all cookies or to indicate when a cookie is being sent.  However, if attendees do not accept cookies, they may be unable to use portions of the Service.

  1. Use of Data

Carnival en Cancun uses collected data for various purposes including but not limited to:

  • To maintain the Service.
  • To notify you about changes to the Service.
  • To allow participation in interactive features of the Service.
  • To provide customer care and support.
  • To analyze and improve the Service.
  • To detect, prevent and address technical issues.
  1. Transfer of Data

Attendees’ information, including Personal Data, may be transferred to, and maintained on, computers located outside of attendees’ state, province, country, or other governmental jurisdiction where data protection laws may differ from attendees’ jurisdiction. Attendees’ consent to this Privacy Policy followed by your submission of such information represents your agreement to said transfer. The Carnival en Cancun Management Team will take all steps reasonably necessary to ensure that data is treated securely and in accordance with this Privacy Policy and that no transfer of Personal Data takes place to an organization or country unless there are adequate controls in place to secure attendees’ data and other personal information. 

  1. Disclosure of Data Legal Requirements 

Carnival en Cancun may disclose attendees’ Personal Data in the good faith belief that such action is necessary to:

  • To comply with a legal obligation.
  • To protect and defend the rights or property of the Hotel Riu Palace Las Américas.
  • To prevent or investigate possible wrongdoing in connection with the Service.
  • To protect the personal safety of users of the Service or the public.
  • To protect against legal liability.
  1. Security Of Data

The Service uses SSL encryption to ensure that data is protected during transmission. Upon successful submission, data will be securely stored on the Service’s server and protected by a Firewall. Carnival en Cancun uses regular malware scanning to ensure that the Service is protected so as to prevent unauthorized access to your data. DISCLAIMER: While the security of your data is important to us, note that no method of transmission over the Internet, or method of electronic storage is 100% secure. Carnival en Cancun strives to use commercially acceptable means to protect Personal Data; however, it does not guarantee absolute security.

Carnival en Cancun may employ third-party companies and individuals (“Service Providers”) to facilitate the Service, provide the Service on Carnival en Cancun’s behalf, perform Service-related services, or assist in analyzing use of the Service.  Service Providers may have access to attendees’ personal data for the sole purpose of performing such tasks and are obligated to refrain from disclosing or using said personal data for any other purpose.

Carnival en Cancun may use third-party Service Providers to monitor and analyze the use of our Service.

  1. Links to Other Sites

The Service may contain links to other sites that are not operated by Carnival en Cancun.  Carnival en Cancun strongly advises attendees to review the Privacy Policy of every site visited. Carnival en Cancun has no control over and assumes no responsibility for the content, privacy policies, or practices of any third-party website(s) or service(s.)

  1. Privacy of Minors

The Service does not address individuals under the age of 18 (“minor(s)”) and Carnival en Cancun does not knowingly collect personally identifiable information from minors.  Parents or guardians who become aware of a minor’s submission of Personal Data to the Service are advised to contact Carnival en Cancun’s Management Team immediately. 

  1. Changes To This Privacy Policy

Carnival en Cancun reserves the right to unilaterally update its Privacy Policy at any time.  Amended Privacy Policies will be posted to the Service accordingly.  Attendees will be notified of changes to the Privacy Policy in advance of the effective date via email and/or a prominent notice on the Service.  Attendees are hereby advised to review this Privacy Policy periodically for any changes.

Terms & Conditions

PAYMENTS:

Packages consist of a four-day, three-night, all-inclusive stay at the Hotel Riu Palace Las Américas, admission to all Carnival en Cancun events, and transportation to and from Carnival en Cancun events where applicable.

A minimum payment of $250 is due at the time of registration via the carnivalencancun.com payment platform.  Package balances may be paid in full any time prior to March 19, 2021, or pursuant to the following payment schedule:

Attendees’ balances must be paid in full by March 19, 2021.  Attendees choosing to utilize the above-referenced payment plan will be invoiced via PayPal and payments are to be made via the said platform.

Carnival en Cancun packages do not include airfare to and/or from Cancun, Mexico.

The Carnival en Cancun Management Team retains the right to charge an administrative fee, which shall not exceed 20% of the registration fee.  

CANCELLATION AND REFUNDS:

Attendee cancellations due to positive COVID-19 Test results shall be subject to a cancellation fee equal to 20% of the attendee’s registration fee ($50).  Attendees must submit proof of a positive COVID-19 Test result to be refunded.  NOTE: Attendees’ proof of positive COVID-19 Test results must be provided by Carnival en Cancun to Hotel Riu Palace Las Américas for all cancellations made on or after March 9, 2021.  Upon approval of cancellation, attendees shall be refunded all deposits paid to date, less 20% of the attendee’s registration fee ($50).  

Attendee cancellations made on or before March 8, 2021, and due to reasons other than positive COVID-19 Test results, shall be subject to a cancellation fee equal to 50% of the attendee’s registration fee ($125).  Upon approval of cancellation, attendees shall be refunded all deposits paid to date, less 50% of the attendee’s registration fee ($125).

Pursuant to resort payment policies and third-party contractual obligations, Carnival en Cancun is unable to issue refunds for cancellation requests submitted on or after March 9, 2021. In some cases, attendees may be entitled to resort credits for future use due to cancellations on or after March 9, 2021; however, Carnival en Cancun is neither responsible for, nor does it guarantee, the issuance of said credits to attendees.  Please contact the Carnival en Cancun Management Team and your case will be reviewed on a case-by-case basis.

All cancellation requests must be made in writing and submitted to the Carnival en Cancun Management team via info@carnivalencancun.com.  Cancellation dates shall be determined by the date an attendee’s writing is received by the Carnival en Cancun Management Team.  Verbal cancellations shall not be binding.  

In the event of the happening of any circumstance beyond the control of the Carnival en Cancun Management Team, including without limitation, acts of God, fire, flood, natural disaster, war or threat of war, acts or threats of terrorism, civil disorder, unauthorized strikes, governmental regulation or advisory, recognized health threats as determined by the World Health Organization, the Centers for Disease Control, or local government authority or health agencies (including but not limited to the health threats of COVID-19, H1N1, or similar infectious diseases), curtailment of transportation facilities, or other similar occurrence beyond the control of the Carnival en Cancun Management Team, where any of those factors, circumstances, situations, or conditions or similar ones prevent, dissuade, or unreasonably delay prospective attendees from appearing at the Hotel, or where any of them make it illegal, impossible, inadvisable, or commercially impracticable to hold the Event, The Carnival en Cancun Management Team retains the right to unilaterally cancel or postpone the event without liability, damages, fees, or penalty.   In the event of cancellation by Carnival en Cancun on or before March 8, 2021, attendees shall be entitled to a refund in the amount of all deposits paid to date less an administrative fee equal to 20% of the attendee’s registration fee ($50).  In the event of cancellation by Carnival en Cancun on or after March 9, 2021, reasonable efforts will be made by Carnival en Cancun to reschedule the event and all packages will be honored for said new dates.

NO SHOWS/EARLY CHECKOUTS

Refunds will not be issued for No Shows or Early checkouts and 100% of all payments to date will be assessed. 


COVID-19 POLICY

All Attendees must undergo PCR or NAAT COVID-19 (not Antigen) testing within three calendar days of April 9, 2021, and provide proof of negative test results to the “Carnival en Cancun” Management Team prior to travel.  

Effective January 26, 2021, the Centers for Disease Control and Prevention (CDC) requires all air passengers entering the United States (including U.S. citizens and Legal Permanent Residents) to present a negative COVID-19 test, taken within three calendar days of departure​, or proof of recovery from the virus within the last 90 days.  As guests of Hotel Riu Palace Las Américas, attendees will have access to FREE on-site COVID-19 antigen testing prior to their return to the U.S.  Testing will be provided by an accredited medical testing lab that complies with the requirements of the CDC and results will be received within 72 hours prior to departure in written and/or electronic format.

CONSENT TO THE USE OF PHOTOGRAPHIC IMAGES 

Registration with, attendance at, or participation in Carnival en Cancun constitutes an agreement by the registrant/attendee to the Carnival en Cancun Management Team’s use and distribution (both now and in the future) of the registrant’s/attendee’s image or voice in photographs, videotapes, electronic reproductions, and audiotapes.

WAIVER OF LIABILITY AND RELEASE

In consideration for being allowed to participate in Carnival en Cancun, attendees hereby warrant and represent that they are age 18 or above and knowingly release, waive, discharge and covenant not to sue Carnival en Cancun, its Management Team, and each of their respective partners, shareholders, affiliates, directors, officers, fiduciaries, employees, agents and volunteers and each of the partners, shareholders, affiliates, directors, officers, fiduciaries, employees and agents of each of the foregoing (hereinafter referred to as “Releasees”) from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by attendees or any of the property belonging to attendees, whether caused by the negligence of the Releasees, while participating in Carnival en Cancun or while in, on or upon the premises where Carnival en Cancun and/or related activity is being conducted. 

Attendees hereby warrant that they are fully aware of the risks involved and hazards connected to their participation in Carnival en Cancun, including but not limited to travel risks. Attendees hereby elect to voluntarily participate in said activity with full knowledge that said activity may be hazardous to attendees and their property. Attendees knowingly and voluntarily assume full responsibility for any risks of loss, property damage, or personal injury, including death, that may be sustained by attendees, or any loss or damage to property owned by attendees, as a result of being engaged in Carnival en Cancun, whether caused by the negligence of Releasees or otherwise. Attendees further hereby agree to indemnify and hold harmless the Releasees from any loss, liability, damage, or costs, including court costs and attorney fees, that they may incur due to attendees’ participation in Carnival en Cancun, whether caused by the negligence of Releasees otherwise.

Attendees knowingly and voluntarily intend for this Waiver of Liability and Hold Harmless Policy to constitute an Agreement between Releasees and attendees.  Attendees knowingly and voluntarily intend for this Waiver of Liability and Hold Harmless Agreement to binding the members of attendees’ families and spouses if attendees are alive, and attendees’ heirs, assigns, and personal representatives if attendees are deceased, and knowingly and voluntarily intend for this Waiver of Liability and Hold Harmless Agreement to be deemed as a release, waiver, discharge, and covenant not to sue the RELEASEES.  Attendees hereby further agree that this Waiver of Liability and Hold Harmless Agreement shall be construed in accordance with the laws of the State of New York.

INDEMNIFICATION

Attendees hereby warrant and represent that they are age 18 or above and hereby knowingly and voluntarily agree to indemnify, exonerate and hold Carnival en Cancun, its Management Team, and each of their respective partners, shareholders, affiliates, directors, officers, fiduciaries, employees, agents and volunteers and each of the partners, shareholders, affiliates, directors, officers, fiduciaries, employees and agents of each of the foregoing (collectively, the “Indemnitees”) free and harmless from and against any and all actions, causes of action, suits, losses, liabilities and damages, and expenses in connection therewith, including without limitation reasonable attorneys’ fees and disbursements (collectively, the “Indemnified Liabilities”), incurred by the Indemnitees or any of them as a result of, or arising out of, or relating to the execution, delivery, performance, enforcement or existence of Carnival en Cancun or the transactions contemplated hereby, whether caused by the negligence of the Indemnitees or otherwise.
